Transgender politics – like any politics – can be divisive. Yet in the case of Karen White, who is legally still a man but was put in a female-only prison, both sides of the transgender rights debate are united in the belief mistakes were made.

跨性別政治往往是充滿爭議的，但只有在凱倫懷特的案例上，雙方達成了共識，這是個錯誤。

這個受刑人在進入監獄前就有多起戀童、性侵、暴力前科，然後她還是進入了女性監獄，並且立刻性侵多位女性獄友。

這篇是2018年的，這名受刑人已經被判終身監禁，最低九年後才能假釋，目前已開始接受跨性別的手術。

“She was always calling the police accusing us of hate crimes against her. And then she started getting violent – it was a terrifying time for all of us – we wish she had never been placed here.”

在進入監獄之前，她原先居住地的住戶對這個人非常恐懼，她在該公宅彷彿施行恐怖統治，時常威脅住戶她要報警，也確實常常報警，指控住戶針對她仇恨犯罪。

The final straw came when White repeatedly stabbed an elderly male resident in his own home, claiming the pensioner had sexually assaulted her. The man said: “She just went for me – it was completely out of the blue. I still feel scared in my own home.”

她再度入獄是因為刺殺一名退休高齡男子，她宣稱這名男子性侵她。

她改過幾次名字：Stephen Terence Wood→因猥褻加上猥褻兒童入獄的時候改名為David Thompson→Karen White

我有點好奇她為什麼可以一直改姓，在英國改姓氏沒有什麼規定嗎？

White’s arrest for that stabbing and a burglary in 2017 came just as the Ministry of Justice updated its policy “on the care and management of transgender prisoners” after the death of two trans prisoners in male prisons.

在她入獄之前，英國法務部剛剛更新他們的跨性別政策，因為有兩名跨性別死於男子監獄。

The new 60-page policy introduced in January 2017 emphasised the right of prisoners to “self-identify” and to be treated “according to the gender in which they identify”.

這份新的政策在2017月頒訂，強調囚犯的自我認同權利，以及依據他們的自我認同得到(恰當的)對待。

Previously, prisoners requiring such treatment would have needed a Gender Recognition Certificate (GRC) or to have had a medical diagnosis of gender dysphoria.

A government survey has counted 125 transgender prisoners in England and Wales, which is likely to be an underestimate.

According to MoJ figures released in response to a freedom of information request by the BBC, 60 of them have been convicted of one or more sexual offences.

The government is currently carrying out a consultation about reforming the Gender Recognition Act.

In September 2020 the UK government published the results of the public consultation which showed wide support for all aspects of reform, including 64% in favour of removing the requirement for a diagnosis of Gender dysphoria and 80% in favour of removing the requirement for a medical report.

However the UK government decided not to change the current law, which was described as "a missed opportunity" by the Equality and Human Rights Commission.

諮詢的結果在2020年出版，顯示民眾廣泛支持法案改革，有64%支持移除對性別不安的診斷要求，80%贊成移除醫療報告要求。

然而英國政府決定不修法，平等與人權委員會表示這是一次錯失機會。

這篇報導列出許多對White比較不利的證言。包括她本人，同監獄的受刑人，還有受害者的詳細資訊。
2019年的的時候White公開募款，希望能贊助她進行變性手術，幫助她移監回到女子監獄，因為她在男子監獄很不快樂，都不能化妝。

Trans inmate jailed for Wakefield prison sex offence...BBC的報導包含的細節不同，但呈現出來的形象也是很可怕。
這樣前三個搜尋結果比較起來，衛報真的是最友善的。

She also admitted to probation officers she was sexually interested in children and could abuse a child and "think nothing of it".

The two counts of rape did not come to light until one of the victims came forward after White wrote to her from prison.

The woman, in her 20s, said White had violently raped her five or six times between January and December 2016, after meeting at a psychiatric unit in West Yorkshire.

這麼窮凶極惡的犯罪者也是不多見，偏偏在相關體制改革跟推動修法的時候高調犯罪。

英國的跨性別也真是夠倒楣的，等改革等很久，一出現曙光就遇到這個負面案例，負面到簡直無懈可擊，犯罪經歷、人格特質、曝光時間點跟犯罪地點都是最惡劣的宣傳素材。

讀這類案例的時候我反射性地會一直想要找到各種細節，去證明這個人是真的跨性別或者不是，但是實際上跨權提倡者並不贊成要求任何證據。
我的困惑一直都沒有得到解答，假設二元性別的分類法不適用了、二元性別定義應該被質疑，那跨性別究竟是憑什麼標準認定自己屬於二元性別其中之一(或者不屬於)？
non-binary的政治訴求往往也與跨男跨女不同。

二元性別在不同的時代、地點或族群中都應該有不同的定義。
而多數人對異性處境的理解就是沒有理解。
二元架構下個體差異非常大。
但是如果這個二元邊界本來就不存在，這套系統不會簡單地被執行，少說數百年而不動搖。

在我查White的資料時，另一個跨性別性侵犯的名字一起跳出來，Michelle Winter，在2020年因性侵被逮捕，在2021初被判刑15年。
相關的報導都不是我認識的媒體，內文看起來也比較偏主觀，所以我就不貼了。
Winter到底要關在男子監獄還是女子監獄似乎還沒有公開，他還沒動過手術，在審判文件中是以女性代名詞代稱。

目前至少有六名關在女子監獄的跨女有性侵的前科。
我需要再查查這個數字怎麼來的。
所以還是貼上來源好了。

只有我想說不管什麼性別，性侵別人的人讓他們自己關一間不要跟沒有性侵前科的人一起關嗎.....

是說JK羅林一直想主張有些人只是聲稱自己是跨性別，並非是真正的跨性別而是利用這個身份，就是這點主張傷害了跨性別，她才這麼被憎恨。
許多跨性別表示，醫師診斷還有跨性醫療的費用很高，所以他們認為要求提出證明本身就是迫害。
我認為，如果將來，大家都接受了跨性別不需要符合任何條件也是跨性別的話，那對跨性別的形象可能才是最嚴重的打擊。對跨性別親善的人，對跨主要印象應該都是些堅強的人或是優秀的表演者，但繼續這樣發展下去，越來越多人對跨的印象應該會是犯罪者或是運動員。

chiyau: 男子監獄可能有衣著規定吧，比如說她很想使用假乳房襯墊，但被認為便於藏匿東西所以不行。她在女子監獄的時候肯定有使用，因為她還會翻出來給別的受刑人看，性騷擾她們。

我覺得jk大概就是知道實務上會有多少漏洞可以鑽才會那麼強硬的提出這樣的主張（也導致她被那麼多人討厭）

White’s is not an isolated case – there have been at least six other sex attacks in women’s jails by transgender convicts.

衛報報導，有一名服刑完的受刑人，控訴她遭到跨性別受刑人性侵，但英國法務部並不承認這起事件。被指控的受刑人是持有GRC的，也就是完成變性的證明。

The claim has been brought by lawyers on behalf of an unnamed woman who served nearly four years in prison.
這位匿名的原告曾在監獄服刑四年。
In August 2017, while in HMP Bronzefield, in Middlesex, she said she was sexually assaulted by a trans woman prisoner who holds a gender recognition certificate (GRC). The MoJ does not accept that there was an assault.

The prisoner with a GRC, who allegedly carried out the attack, Monaghan said, had convictions for serious sexual offences against women but was housed in the general population of a women’s prison.

女子受刑人只佔了英國受刑人的4%。

英國法務部的委任律師認為，原告所關注的不是她個人被性侵的問題，而是要求有暴力跟性侵前科的的跨性別受刑人都不能收容在女子監獄，不考慮任何個人因素，就這點來說她提出的訴求可能不夠強而有力。

這個案子還在進行中，要明年(2021)才會知道結果。

A transwoman who raped a female in an horrific attac...上面貼的這篇文章，應該不能算是報導，作者宣稱自己也是跨性別者。她的結論是女性有權住在單一性別的監獄，跨性別亦同，所以她支持跨性別監獄。

Women prisoners have a right to single-sex accommodation, no ifs no buts and no loopholes, and I say that as a transgender person myself.

Rather than campaigning to infringe the rights of women, transgender campaigners should be calling for transgender rights to be protected within the prison system designated for our sex: single-cell accommodation, separate washing and toilet facilities, and further protection that may be necessary.

她認為應該有單獨的牢房，分開的衛浴廁所，還有更進一步的保護對跨性別來說都是必要的。

我剛想了一下為什麼跨性別要單人監獄
因為跨性別每個人都是不一樣的性別？
這個問題我的直覺答案是yes，但差別大到到應該每個人都有單人牢房？又或者是單一性別監獄中，尤其是暴力事件頻繁的男子監獄是否更應該有單人牢房？暫且撇開預算成本的問題，單人監禁是否有不人道的問題？

我一直在想，受到霸凌跟性侵的跨女希望躲在安全的女子監獄，但是為什麼跨女非常確定她們的加害者不會申請到女子監獄呢？跨女覺得只要能遠離那個環境就能逃離加害者，但跨女跟加害者之間有什麼決定性的差異可以隔絕加害者於女子監獄之外嗎？

跨女可能一輩子也沒有看過順男假裝跨女，是因為跨女是弱勢族群，但一旦不需要手術也不需要精神科醫師的診斷，就可以宣稱自己是跨性別的話，順男宣稱自己是跨性別的利益不存在嗎？
就算完全不是惡意好了，普通受霸凌的弱勢順男如果轉到女子監獄去也是一種利益，但在男子監獄是受害者的人，到了女子監獄還是可能轉變成加害者啊？難道我們只能期待順女受刑人不顧一切寧可被判無期徒刑也要在監獄內動用私刑來反抗了嗎？

如果將跨女放在跨女監獄搞不好還是會發生性侵案...

po_shua: 對啊……英國也在施行跨性別監獄了，我們應該很快就有實際數據可以看了

至少兩個跨女在監獄發生性關係是已經出現在英國的個案。
我昨天讀到的，就是一個「喜歡男人的」跨女跟另一個跨女獄友在女監談戀愛，然後他們因為當眾性交被拆散了，其中一人移監。
這種應該不是性侵，不過監獄本來就不能發生性關係。
